Terms Of Service:

Services reserves the right to change
this TOS at any time, without notice to
the customer.
Server Use
-
Hostspot Web
Services will not tolerate inappropriate
use of our servers and resources. We
reserve the right to suspend a customer's
account at our sole discretion without
prior notice. Any domain found to be
jeopardizing server performance and thus
affecting normal server operation or
service to other Hostspot customers will
be suspended without prior notice.
Content Policy
Hostspot Web
Services does not allow any illegal
material to be stored on our
servers.Transmission, storage, or
presentation of any information, data or
material in violation of any United
Kingdom, United States or European law is
prohibited. The subscriber agrees to
indemnify and hold harmless Hostspot Web
Services from any claims resulting from
the use of the service which damages the
subscriber or any other party.
Legal Adult
material and sex-related links or
merchandising is allowed on Hostspot
servers, with the 'business power
plan'.This includes sites that contain
legal pornography, or links to adult
content elsewhere. The designation of
"adult material" is left
entirely to the discretion of Hostspot
Web Services. We must be notified if you
plan to have adult content on your
website, this allows us to ensure your
account is located on a server which
permits this content.
Prohibited sites
that promote any illegal activity or
present content that may be damaging to
Hostspot Web Services servers or any
other server on the internet.
Infringement of Copyright, Patent,
Trademark, Trade Secret, or Intellectual
Property Right: Distribution and/or
posting of copyrighted or the
aforementioned infringements will not be
tolerated.
Links to such materials are also
prohibited. Examples of unacceptable
content or links:
Pirated
software
Hacker programs or archives
Warez sites
Hostspot Web
Services will be the sole arbiter as to
what constitutes a violation of this
provision. Any deliberate attempt to
cause damage to Hostspot Web Services or
any other Internet servers will result in
immediate account deactivation without
prior notice. No refund will be issued.
Spam
The sending of mass
automated unsolicited email is strictly
not permitted on the hostspot servers,
any person found abusing this policy will
be billed at a rate of £5.00 per
unsolicited message sent. Accounts found
spaming will be deleted without notice.
This policy will be enforced and
collection of money owed for this abuse
will be passed to a debit collection
agency upon failure to pay.

- Backups

It is your
responsibility to ensure you back-up your
site. You should keep a copy of your site
on your local computer, and back-up all
databases regularly. Customer agrees that
Hostspot Web Services are not liable for
loss of content on your site.
Indemnification Policy
Hostspot Web
Services reserve the right to refuse
service to anyone for any reason not
prohibited by law. We also reserve the
right to terminate service to any
customer for any reason not prohibited by
law. You agree to use all Hostspot Web
Services services at your own risk.
Hostspot Web Services specifically
disclaims all warranties of
merchantability and fitness for a
particular purpose. In no event shall
Hostspot Web Services be liable for any
loss, or loss of data, or other
commercial damage, including but not
limited to special, incidental,
consequential or other damages. Customer
agrees that it shall defend, indemnify,
save and hold Hostspot Web Services
harmless from any and all demands,
liabilities, losses, costs and claims,
including reasonable attorney’s fees
asserted against Hostspot Web Services,
its agents, its customers, officers and
employees, that may arise or result from
any service provided or performed or
agreed to be performed or any product
sold by customer, it’s agents,
employees or assigns. Customer agrees to
defend, indemnify and hold harmless
Hostspot Web Services against liabilities
arising out of:
any injury to person or property caused
by any products sold or otherwise
distributed in connection with Hostspot
Web Services' servers;
any material supplied by customer
infringing or allegedly infringing on the
proprietary rights of a third party;
copyright infringement and any defective
products sold to customer from Hostspot
Web Services' server.
Hostspot Web Services shall be the sole
arbiter as to what violates this Policy.
Bandwidth and Disk Usage
Customer agrees
that bandwidth and disk usage shall not
exceed the number of megabytes per month
for the Services ordered by Customer on
the Order Form (the "Agreed
Usage"). Hostspot will monitor
Customer's bandwidth and disk usage.
Customer accounts which go over their
bandwidth allocation may have their
accounts temporarily suspended, we will
always try to avoid this by arranging a
special high bandwidth account where
neccessary. Additional bantwidth is
currently charged at a rate of £2 per
month per gigabyte for all customers.
Cancellations
and Refunds
Notification to
cancel your account may be made at any
time. To cancel your account, simply
contact us with a support ticket. No fees or
prepaid hosting will be refunded . If you
choose to re-sign up after cancellation,
you must pay the first month's fee. All
monetary transactions are in £GBP
Sterling.
